La juritraductologie, nouvelle discipline, échappe-t-elle à l’histoire ?

Abstract : Juritraductology, announced as a new discipline, was it born ex nihilo? Or would it be the emergence of the evolution of translation studies based on the millennial history of translation activity, whether legal or not? As everyone carries, by their descent, the history of their father, and through him, of their ancestors, would legal translation only carry the genes of translation studies and linguistics? Questions of a methodological nature, in order to properly translate the law, have also been raised in legal science, and in particular by comparative jurists. Therefore, would not juritraductology be rather the fruit of the meeting of two histories: that of law and that of translatology? Comparing rights and translating languages are activities that go back to the dawn of time. Both translation and comparison of rights already existed in antiquity. However, their emergence as a discipline has only occurred in recent history. The history of public international law constitutes the beginnings of the meeting of comparative law and translation studies. This communication proposes to expose the parallelism of the emergence and evolution of these two disciplines: comparative law and translation studies. Their respective emergence and epistemological development turned out to be chaotic. Both comparative law and translation studies have struggled, and still struggle today, to be considered as disciplines in their own right. Both have struggled to break free from their parent discipline: law and linguistics. Two stories which in turn contributed to the emergence of part of the epistemological framework of juritraductology.
